Najib is not Convinced as he Appeals High Court's Rejection, Pursues House Arrest Order

In a recent legal development, Datuk Seri Najib Razak has decided to appeal the High Court's dismissal of his application for judicial review regarding an alleged Titah Addendum (additional order) from the 16th Yang di-Pertuan Agong. This order purportedly directs him to serve the remainder of his prison sentence at home.

Najib's lawyer, Tan Sri Muhammad Shafee Abdullah, confirmed after the court proceedings that Najib has instructed him to file an appeal with the Court of Appeal promptly. This decision comes following Judge Datuk Amarjeet Singh's ruling against Najib's application.

The former prime minister contends that the Malaysian government has avoided addressing the existence of the additional order, which has caused confusion and necessitated judicial review. Shafee expressed frustration over the government's reluctance to clarify its stance on the matter.

"If the government boldly states that no such additional order exists, then there would be no need for further court appearances. We could all return home and rest. The silence on their part raises questions about what they might be concealing," Shafee remarked, highlighting the contentious nature of the issue.

Najib, as the applicant, has named multiple respondents in his legal challenge, including the Home Minister, Commissioner General of Prisons, Attorney General, and the Federal Territories Pardon Board, among others. His application seeks a mandamus order compelling these parties to confirm the existence of the alleged additional decree dated January 29, 2024.

Furthermore, Najib requests a mandamus order directing the enforcement of this decree, if confirmed, by transferring him from Kajang Prison to his residence in Kuala Lumpur. This move would enable him to serve the remainder of his prison term under house arrest.

The legal saga surrounding Najib Razak continues to draw attention due to its implications for executive authority, judicial oversight, and the interpretation of constitutional provisions regarding pardon powers. The appeal to the Court of Appeal signifies Najib's determination to challenge the High Court's decision and seek clarity on the validity of the alleged Titah Addendum.
