The Kuala Lumpur High Court’s decision on 22 December 2025 to dismiss Datuk Seri Najib Razak’s application for house arrest prompted an emotional public response from his daughter, who expressed regret and encouragement as her father remains incarcerated.
Following the ruling, Najib’s daughter shared her reaction by highlighting key points from the court’s judgment explaining why the alleged addendum order that could have allowed house arrest was deemed unenforceable. The court determined that the purported directive, said to have originated from the 16th Yang di-Pertuan Agong, did not meet constitutional requirements and therefore carried no legal effect.
According to the judgment, the monarch’s powers are exercised within the framework of the Federal Constitution, including matters related to the royal prerogative of mercy. The court found that the alleged addendum order had not been deliberated or approved during the 61st Federal Territories Pardons Board meeting. As a result, mandatory procedures under Article 42 of the Constitution were not fulfilled, rendering the order invalid.
In her response, Najib’s daughter conveyed disappointment over the outcome and acknowledged that the decision was not favourable. She later shared further excerpts from the ruling, reiterating the court’s position that any exercise of royal authority must strictly comply with constitutional provisions and established processes.
As confirmation emerged that Najib would continue serving his sentence at Kajang Prison, she addressed her father directly with a personal message. She urged him to remain patient and resilient despite the setback, while emphasising the importance of safeguarding his health during his incarceration. Her message reflected confidence that the legal struggle was not yet over and that perseverance would remain essential in the days ahead.
Najib, the former prime minister, is currently serving a jail sentence after being convicted of misappropriating RM42 million from SRC International Sdn Bhd, a former subsidiary of 1Malaysia Development Berhad (1MDB). His application for house arrest was linked to claims of an addendum order that would have allowed him to serve the remainder of his sentence at home rather than in prison.
The High Court’s ruling effectively closed that avenue for now, confirming that Najib must remain behind bars unless a higher court decides otherwise. His legal team has indicated that an appeal will be filed, signalling that the matter is expected to proceed to the next stage of judicial scrutiny.
As the legal process continues, the decision has drawn widespread attention, not only for its constitutional implications but also for the personal toll it has taken on Najib’s family. For the moment, however, the court’s ruling stands, keeping Najib in Kajang Prison while his lawyers prepare their next move.
