Najib Seeks Judicial Review, Arguing Royal Pardon Grants House Arrest

Former Prime Minister Datuk Seri Najib Razak has taken legal action by filing a judicial review application to seek permission to serve the remainder of his prison sentence under house arrest. He claims that an addendum order by the Yang di-Pertuan Agong, granted to him on January 29, allows him to serve his sentence at home.

The application, submitted through law firm Messrs Shafee & Co on April 1, names various government officials as respondents, including the Home Minister, Commissioner General of Prisons, Attorney General, Federal Territories Pardons Board, Minister in the Prime Minister's Department (Law and Institutional Reform), director general of legal affairs at the Prime Minister's Department, and the government.

In his application, Najib seeks a mandamus order for the respondents to verify the existence of the addendum order dated January 29. If confirmed, he requests the execution of the Royal order to transfer him from Kajang Prison to his residence in Kuala Lumpur for house arrest. Additionally, Najib seeks a copy of the royal decree by the 16th Yang di-Pertuan Agong regarding the reduction of his prison sentence and fine, as well as the addendum order.

Najib asserts that he informed both Al-Sultan Abdullah Riayatuddin Al-Mustafa Billah Shah and His Majesty Sultan Ibrahim, King of Malaysia, of his intention to file the judicial review application. He justifies withholding the letters to the Rulers as exhibits due to confidentiality.

The former Pekan MP emphasizes the urgency of his application, requesting a hearing before Hari Raya Aidilfitri, which is expected on April 10. The hearing is scheduled for April 4 before High Court Judge Justice Amarjeet Singh.

Najib was initially sentenced to a 12-year imprisonment and fined RM210 million for charges related to abuse of power, criminal breach of trust, and money laundering in connection to RM42 million from SRC International, a former 1MDB subsidiary. Following the royal pardon, his jail term was reduced to six years, with a reduced fine of RM50 million. As it stands, Najib is scheduled for release on August 23, 2028, and is currently serving his sentence at Kajang Prison.
