Nik Elin Zurina Nik Abdul Rashid, the lawyer who recently secured victory in her constitutional challenge against the state of Kelantan, has confirmed her membership in Muafakat Nasional (MN) and Umno. However, she clarified that her involvement in politics does not extend to active participation as a politician.
In an interview with the New Straits Times podcast, Nik Elin disclosed her affiliation with MN, explaining that she was invited to join by the MN president. She highlighted MN's emphasis on unity, love, freedom, and justice, values she believes are beneficial for Malaysia. Despite her political party memberships, Nik Elin reiterated that she does not consider herself a politician and merely aligns with parties that resonate with her beliefs.
Responding to assertions by various parties, including Prime Minister Datuk Seri Anwar Ibrahim, regarding her MN membership, Nik Elin emphasized that her constitutional challenge was an independent effort. She clarified that no political party had sponsored or supported the legal action, which was undertaken solely by herself, her daughter Tengku Yasmin Natasha Tengku Abdul Rahman, and their team of lawyers.
Nik Elin and her daughter challenged the constitutionality of 18 provisions under the Kelantan Shariah Criminal Code (I) Enactment 2019, arguing that the Kelantan State Legislature lacked jurisdiction to enact laws on these offenses due to existing federal legislation covering similar matters. The Federal Court's ruling on Friday declared 16 out of 18 provisions of Kelantan's Shariah Criminal Code invalid, citing the state legislative assembly's overreach or lack of authority.
Following the landmark decision, Nik Elin hailed the Federal Constitution as the supreme law of the nation, emphasizing the court's affirmation of its supremacy. She clarified that the constitutional challenge was not aimed at questioning Islamic doctrines but rather focused on the competency of state legislative assemblies, as determined by the Federal Court.
