“No Receipt, No Refund”? Not Necessarily! Here’s What M’sians Should Know

Imagine buying a new gadget at the mall, only for it to stop working a week later. You head back to the shop, ready to ask for help, when the salesperson asks those dreaded words:

“Do you have the receipt?”

Alamak. That tiny piece of paper probably went into the rubbish bin along with the shopping bag. But before you say goodbye to your hard-earned money, here’s something worth knowing: losing your receipt doesn’t automatically mean losing your consumer rights.

No receipt, no rights? Not quite!

Under Malaysia’s Consumer Protection Act 1999, consumers have certain protections when products are faulty or fail to meet the law’s guarantees.

Section 140 also requires suppliers to issue receipts in circumstances covered by the Act, including when consumers request them. However, it doesn’t say your rights disappear just because you’ve misplaced one.

Of course, this doesn’t mean every shop must immediately refund you. Depending on the circumstances, you may be entitled to a repair, replacement or refund. You’ll still need to establish what you bought, where you bought it and why you’re entitled to a remedy.

And if you simply changed your mind about that impulse purchase? Different story! The law doesn’t generally guarantee a refund just because you no longer want something.

Paid with your card? Don’t give up just yet!

Before turning your entire house upside down looking for that missing receipt, check your banking app.

That transaction history might help establish when and where you paid. Better still, combine it with other records, such as:

  • E-receipts or online order confirmations
  • Warranty cards or purchase agreements
  • Messages exchanged with the seller
  • Bank transaction records or payment slips

For example, if you bought a faulty RM200 appliance, a bank transaction showing payment to the retailer, together with a warranty document identifying the product, may help support your case.

The Tribunal for Consumer Claims Malaysia (TTPM) advises claimants to prepare supporting documents and bring witnesses where available.

Just remember, a bank statement alone doesn’t necessarily prove which product you purchased, and alternative evidence doesn’t guarantee a successful claim.

Shop still refusing to help? Here’s your next move

Start by asking the retailer whether it can retrieve your transaction using the purchase date, payment details or membership account.

If the dispute remains unresolved, eligible consumers can consider filing a claim with TTPM.

The tribunal generally handles qualifying consumer claims of up to RM50,000, provided the claim arises within three years of the relevant cause of action. The filing fee is RM5, although certain disputes fall outside its jurisdiction.

And the next time you buy an expensive gadget or appliance, take a photo of the receipt before it disappears into the Bermuda Triangle of shopping bags and old bills.

Because losing a tiny piece of paper shouldn’t automatically mean giving up on your rights.
