Kota Kinabalu: A 32-year-old man was fined RM5,500 or seven months’ jail by the Magistrate’s Courts here for operating entertainment premises without a licence.

Kong Yun Lung pleaded guilty to committing the offence at the Hive Bah Cafe & Bar, Cyber City Kepayan, in Penampang at 11.23pm on Dec 1, this year.

AdvertisementKong was found to be manning entertainment business without a valid licence issued under Section 6 (1) of the Public Entertainment Ordinance (PEO) 1958.

He was charged under Section 4 of the PEO 1958 and punishable under Section 11 of the same Ordinance which provides for a fine of up to RM50,000 or up to one year jail, or both, on conviction.

Read more The facts of the case presented by the prosecution stated that the police had raided the premises as part of Operation Noda and found that the establishment was in operation, with music being played and customers singing karaoke and drinking alcoholic beverages.

Investigations revealed that the premises was using services business licence and breached the condition of the stipulated licence by operating entertainment activity without a valid licence.

In another case, a 20-year-old man was ordered to pay a fine of RM1,100 or one month jail for engaging in online gambling activity in public.

The charge under Section 7(2) of the Common Gaming House Act 1953 carries a fine of up to RM5,000 or a jail term of up to six months, or both, on conviction.

The prosecution, in tendering the facts of the case, stated that Syameerul had been arrested by the police for his involvement in illegal gambling activities.

Police investigations revealed that Syameerul had purchased lottery tickets without a valid licence.

Syameerul requested a lenient sentence.

Meanwhile, two men were charged with hiding stolen properties.

Julian Said, 37, and Shahrizan Misdaranai, 39, pleaded not guily to conceal the stolen items – two OCBC Bank tokens, two CD Microsoft Office Software, eight CDs and insurance documents on Nov 2, at 8.30pm, at the roadside of Jalan Kampung Kota Bungan, here.

They were charged under Section 414 of the Penal Code read with Section 34 of the same Code, which carries a jail term of between six months or seven years and liability of a fine on conviction.

Inspector Alia Nuurlysa Adnan in applying for pre-trial case management (PTCM), proposed bail at RM6,000 in two sureties on each accused.

She also applied for Julian to report to the investigating officer once a month, as he was a repeat offender, having been charged with various offences.

Unrepresented, Julian requested a lower bail, citing that he had children and an ailing mother.

Duty Counsel Carmen Khoo, representing Shahrizan, also requested a lower bail, stating that he was a divorcee, worked as a general worker, and was taking care of his two children.

The court fixed Feb 17 for PTCM and released Julian and Shahrizan bail at RM2,000 and RM1,800, respectively in two sureties.

Both accused were also ordered to report to the investigating officer once a month.
