
Malaysia’s Syariah Judicial Department resolves 13,920 alimony arrears cases from 2020-2025, using legal enforcement and support funds to aid ex-wives
KUALA LUMPUR: A total of 13,920 cases of alimony arrears involving ex-wives were successfully resolved between 2020 and 2025. The Malaysian Syariah Judicial Department (JKSM) achieved this through various enforcement initiatives.
Deputy Minister in the Prime Minister’s Department (Religious Affairs) Marhamah Rosli said this reflects the government’s seriousness in addressing payment failures. She stated this dereliction of duty affects the welfare of women and children.
The resolution was driven by the Family Support Division (BSK) through its syariah legal and consultation services. Claims for arrears are pursued through negotiation or the legal process.
“BSK officers who are certified syariah lawyers can represent ex-wives in the Syariah Court,” Marhamah said during the Dewan Negara session. They utilise actions like judgment debtor summons, income detention, and bank account freezes.
She was responding to a question from Senator Dr Jufitri Joha regarding BSK’s effectiveness. The division was created to ensure maintenance orders from the Syariah Court are complied with by ex-husbands.
Regarding the Garnishee Order mechanism, Marhamah said 166 cases have been resolved since its 2022 introduction. This order allows funds to be taken directly from a debtor’s bank account or wages.
She noted several challenges in its implementation, including a lack of cooperation from ex-husbands. Issues also arise when employers are from the private sector or are non-Muslims not bound by Syariah Court orders.
Another challenge is insufficient bank account balances to settle the arrears in full. Despite this, the mechanism is considered effective for enforcement.
Apart from legal action, the government provided an Advance Fund service, channelling RM1.73 million by last December. This ensures the welfare of ex-wives and children is safeguarded while awaiting arrears settlement.
The initiative also includes the BSK Transit service, provided since 2022. It covers travel, food, and accommodation costs for ex-wives attending court proceedings.
Meanwhile, Marhamah praised the Federal Territory Islamic Religious Council (MAIWP) for its assistance. MAIWP channelled RM62.73 million through 10 schemes to 7,683 single mothers in the region throughout 2025.
