Palestine Action terror ban is ruled as lawful – what it means

  • The Home Office has won a court appeal, ensuring Palestine Action's ban under terrorism laws will remain in effect, overturning a previous High Court ruling.
  • A rare five-judge panel at the Court of Appeal determined that the High Court was mistaken in its earlier decision that the group's proscription was unlawful.
  • Palestine Action was initially banned by then-home secretary Yvette Cooper in July 2025 after members reportedly broke into RAF Brize Norton and vandalised jets to protest the war in Gaza.
  • The High Court had previously ruled Ms Cooper's ban unlawful, concluding that only a small number of the group's activities amounted to terrorism and that the proscription was disproportionate.
  • The High Court had also highlighted that Ms Cooper made a 'significant' error by failing to consider the proportionality of the ban, thereby not adhering to the Home Office's own policy on proscription.
