Perak Clarifies Stand on Shariah Criminal Offences Enactment, Ensures Fair Implementation

The Perak State Government has affirmed the validity and constitutionality of its Shariah Criminal Offences Enactment, stating that it remains in force unless legally challenged and annulled. The clarification follows the recent Federal Court ruling concerning the Kelantan Shariah Criminal Code Enactment (I) 2019, which the Perak Chief Minister, Datuk Seri Saarani Mohamad, emphasized does not impact Shariah laws in other states.

Saarani highlighted that the Federal Court's decision pertains to a constitutional issue and does not implicate the standing of Islam or the Shariah Court system in Malaysia. He underscored the need for any amendments to Shariah laws, including the State Shariah Criminal Offences Enactment, to receive approval from the Sultan of Perak.

To ensure comprehensive review and improvement of Shariah laws, Saarani mentioned the existence of the Shariah Legislation Formulation Committee under the Perak Islamic Religious and Malay Customs Council (MAIPk).
