Pharmacy Fined RM50k for Displaying Milk Powder Price RM2 Lower Than Amount Charged to Customers

A pharmacy in Terengganu was fined RM50,000 by the Sessions Court today (May 29) for a RM2 blunder.

According to the charge sheet, in May 2022, Lau & Tan Pharmacy, a well-known pharmacy in Kuala Terengganu, was said to have misled consumers by selling a product (Purenat Golden Goat Milk Powder 800g) at RM91.90, when the display price was RM89.80.

The offence was committed at 9:30 am on May 25, 2022, at a location in Chabang Tiga Commercial Centre. Despite the mere RM2 difference, it is a violation, and the company was charged under Section 12(1)(a) of the Consumer Protection Act 1999, which provides for a maximum fine of RM250,000 if convicted.

Judge Nazlyza Mohamad Nazri imposed the sentence on the company, Lau & Tan Pharmacy Sdn. Bhd. represented by its managing director, Datuk Lau Tiam Kwee. During the defence counsel’s closing arguments, the prosecution proved all the charges beyond a reasonable doubt.

“The punishment is not only meant to give the perpetrators a warning, a lesson, and a chance to repent, but also to serve as a warning to society,” Judge Nazlyza said in her verdict, reported Oriental Daily.

The case was handled by Deputy Public Prosecutor Wan Mohd Koh Zaat and Public Prosecutor Noor Amirah of the Domestic Trade and Cost of Living Department (KPDN).
