The 14-year-old accused in the fatal stabbing of his school senior, Yap Shing Xuen, at a school in Petaling Jaya last year, will face a full trial at the Shah Alam High Court.

Petaling Jaya Magistrate Amira Sariaty Zainal ordered the case to be transferred to the High Court today (30 January). This follows confirmation that the prosecution was granted permission to initiate proceedings under Section 177A of the Criminal Procedure Code.

Evidence is sufficient to proceed

The accused’s lawyer, Kitson Foong, stated that after assessing the evidence, the prosecution believes there are sufficient grounds to proceed with the case. He further confirmed that with the transfer to the High Court, the case is expected to enter the full trial phase.

“The current charge is under Section 302 of the Penal Code for murder,” Kitson told the media today.

The nation was shocked by the murder, which took place on 14 October last year at SMK Bandar Utama 4 in Petaling Jaya. According to the victim’s mother, her daughter was viciously stabbed over 200 times.

During a previous press conference, she denied allegations that the accused had confessed his feelings to her daughter, asserting that the victim did not know the accused personally.

Yap Shing Xuen was only 16 years old at the time of her death.

On 16 January, a mental evaluation report was released, confirming that the 14-year-old defendant is mentally fit to stand trial.
