
PKR confirms Rafizi Ramli and Nik Nazmi Nik Ahmad automatically cease membership after announcing departure from party and parliament seats.
PETALING JAYA: PKR has confirmed that Pandan MP Datuk Seri Rafizi Ramli and Setiawangsa MP Datuk Seri Nik Nazmi Nik Ahmad have automatically ceased to be party members after announcing their decision to vacate their parliamentary seats and leave the party.
In a statement, PKR secretary-general Datuk Fuziah Salleh said the party had received recordings of both leaders publicly declaring their resignation from the party and their intention to relinquish their Dewan Rakyat seats.
The party said their membership was deemed terminated under its constitution upon their declaration of exit.
“Keadilan accepts the decision and, in accordance with Clause 9(1)(c) of the PKR Constitution, their membership is automatically terminated upon their declaration of leaving the party,” it said.
PKR also cited Article 49A of the Federal Constitution, saying the anti-party hopping provision applies when an elected representative ceases to be a member of the party under which they were elected.
“The seat of a member of the Dewan Rakyat shall become vacant if they cease to be a member of the political party under whose ticket they were elected,” the statement said, referring to Article 49A(1)(a)(ii).
The party said the matter would be referred to the Speaker of the Dewan Rakyat for determination under the Federal Constitution.
Fuziah also said PKR would review the status of other party MPs who attended the programme linked to the announcement.
The development comes hours after Rafizi and Nik Nazmi announced their resignation from PKR and plans to join Parti Bersama Malaysia (Bersama), a move now under scrutiny under Malaysia’s anti-hopping law.
