In a recent development in the legal saga surrounding former Malaysian Prime Minister Najib Razak's bid for house arrest, the High Court has admitted two crucial affidavits as evidence. This decision, made by Justice Amarjeet Singh, marks a significant step forward in Najib's attempt to serve the remainder of his prison sentence under house arrest.
One of the affidavits was filed by Najib Razak himself, while the other was submitted by Umno vice-president Wan Rosdy Wan Ismail, offering support to Najib's application.
Initially scheduled to rule on whether to grant Najib leave to commence judicial review proceedings, Justice Amarjeet Singh has now rescheduled the decision to July 3 to accommodate the new evidence.
Senior federal counsel Shamsul Bolhassan confirmed the filing of Najib's additional affidavit, despite objections raised due to its late submission without court permission. However, the judge allowed both affidavits to be included as evidence, emphasizing the importance of considering fresh evidence in the case.
Najib's affidavit reportedly highlights Prime Minister Anwar Ibrahim's speech at the PKR convention in Shah Alam on April 21, suggesting its relevance to his plea for house arrest.
Meanwhile, Wan Rosdy's affidavit reveals information allegedly obtained from Umno Supreme Council member Tengku Zafrul Aziz regarding a purported addendum issued by former Yang di-Pertuan Agong Al-Sultan Abdullah Sultan Ahmad Shah, permitting Najib's house arrest. However, Wan Rosdy clarified that he did not possess a copy of the classified document, which he claims has yet to be executed.
In earlier proceedings, Umno president Ahmad Zahid Hamidi also filed an affidavit corroborating aspects of the alleged addendum, based on information from Tengku Zafrul.
Najib's legal maneuverings stem from his assertion that the supplementary decree was issued during a meeting of the Federal Territories Pardons Board on Jan 29, just before Al-Sultan Abdullah's term ended, yet not announced on Feb 2 as expected. He alleges government contempt for not executing the decree and seeks court intervention to enforce it, potentially securing his house arrest.
This legal battle follows the announcement by the FTPB in February, reducing Najib's prison sentence and fine in the SRC International case. Currently serving his sentence at Kajang prison, Najib's bid for house arrest marks another chapter in his ongoing legal challenges.
