Law enforcement authorities are recommending that Tan Sri Abdul Hadi Awang face sedition charges for challenging the authority of the Pardons Board, which is associated with the royal institution. Deputy Inspector-General of Police Datuk Seri Ayob Khan Mydin Pitchay announced that the police will propose charges against the Pas president under Section 4 of the Sedition Act and Section 233 of the Multimedia and Communications Act.
The final decision on whether to proceed with the charges lies with the Attorney-General's Chambers (A-GC). In regard to cases involving issues related to race, religion, and royalty (3R), the police aim to complete the investigation within one week. Ayob Khan explained that Hadi's statement was recorded at the Pas headquarters, and out of the 24 questions asked, only five were answered. The remaining questions will need to be addressed in court.
The allegations against Hadi stem from a ceramah (public speech) he delivered on August 26 at the Bakri Pas headquarters in Muar. It was reported that Hadi questioned the authority of the Pardons Board, stating that the process of granting amnesty or pardons was not in line with Islamic teachings. According to Hadi, in Islamic tradition, only the victim has the power to grant a pardon.
The police's recommendation for sedition charges indicates a view that Hadi's remarks may have incited hatred or discontent against the Pardons Board and the royal institution. The Sedition Act is aimed at safeguarding public order and national security, while the Multimedia and Communications Act deals with offenses in the digital realm. The decision to pursue charges against Hadi will ultimately depend on the examination and evaluation carried out by the A-GC.
If charges are indeed brought forward, the case will proceed to court, where Hadi will have the opportunity to address the remaining questions and present his defense. It remains to be seen how this legal situation will unfold, as the sedition charges carry potential consequences for Hadi and could impact the ongoing discourse surrounding the authority of the Pardons Board and its alignment with Islamic principles.
