
A telephonic conversation between a Hisar-based YouTuber and a youth from Sundawas village has snowballed into a major controversy after the recording was uploaded on social media, leading to police action, public mobilisation and an ongoing debate over free speech, privacy and social responsibility.
The controversy erupted after objectionable references such as “refugee” and “Pakistani” were allegedly used during a heated phone conversation between YouTuber Vipin Khurana and Sunil Kadwasra of Sundawas village. The audio recording, uploaded by the YouTuber on social media last week, quickly gained traction and triggered strong reactions from different sections of society.
Acting on a complaint lodged by Khurana, the police registered a case against Kadwasra and arrested him on charges related to using abusive and objectionable language and allegedly attempting to create disharmony in society.
However, the arrest only intensified the issue. Two opposing groups have since emerged — one supporting Khurana and condemning the language used against him, and another backing Kadwasra and questioning the circumstances that led to the confrontation.
Members of the group supporting Kadwasra met Hisar SP Sidhanth Jain and demanded a fair probe into the entire episode. They alleged that Khurana was facing eight criminal cases, including charges related to promoting enmity between groups, disturbing public harmony and issuing threats.
According to them, the YouTuber had allegedly attempted to give a caste angle to a murder case in Hansi last week, which provoked Kadwasra to contact him. What followed, they claimed, was a heated exchange in which both parties used abusive and threatening language.
SP Jain said a four-member Special Investigation Team had been constituted to examine all allegations, the criminal cases registered against the YouTuber and the contents of the conversation uploaded online.
“Any further action will be taken on completion of the probe,” he said, while maintaining that despite meetings and discussions by various groups, there was no tension in society at present.
Legal and media experts have also weighed in on the controversy.
Advocate Manmohan Rai said the police acted on a complaint and were duty-bound to investigate. However, he cautioned against allowing the matter to escalate.
“Any use of abusive language is condemnable and let the police conduct a fair investigation into the matter,” he said, adding that “furthering the political agenda should not be allowed from any of the parties.”
Media expert Prof Harish Kumar described social media as a “double-edged sword” with the potential for serious consequences if left unchecked.
He noted that institutions such as the Press Council of India and the News Broadcasting Standards Authority regulate traditional media, but social media platforms often operate without comparable oversight. “The right to free speech should not be allowed to cross limits that create tension in society,” he said, urging governments to take the initiative in addressing the issue.
Offering a legal perspective, Supreme Court advocate Seema Sindhu said: “Calling a person Pakistani or Refugee is a misdemeanour but not an offence in the context of the controversy. Further calling such a thing in private conversation doesn’t promote enmity or cause public disorder or disturb communal harmony in the legal requirement.”
On the issue of the recording itself, she added: “So to the extent of recording it’s not an offence, but publishing it on social media has its own consequences like breach of privacy. In this case it may amount to inflaming public sentiments leading to public disorder.”
