THE prosecution will prove that a senior police officer had knocked his car into a motorcycle ridden by a 17-year-old student, resulting in the student's death last year, the Ipoh High Court heard.
According to reports, deputy public prosecutor Afzainizam Abdul Aziz, in his opening statement on the first day of the trial said the accused's actions in colliding with Muhammad Zaharif Affendi Muhd Zamrie caused him to suffer fatal injuries.
He pointed out that the permitted speed limit at the scene was only 30kph.
"The accused's act of colliding with the deceased was done with the intent to cause injury, and that injury was sufficient, in the usual course, to cause the death of the deceased.
“We will also prove that the accused knew that his act was dangerous and likely to cause death, and the accused acted in such a way with no reason,” he said, adding that the prosecution will present evidence showing that the accused was driving a white Perodua Ativa to SMK Taman Jati Ipoh at the time of the incident.
Afzainizam said the accused had gone to the school area in his car and chased the victim who was on his motorcycle.
"The deceased was riding a motorcycle and was a student at the same school. After leaving SMK Taman Jati, the accused exited and proceeded to follow and pursue the deceased," he said.
Upon reaching the end of the road in Taman Gerbang Meru Indah, the accused and the deceased turned back and headed towards the same route, returning to the intersection of Jalan Taman Jati 1-Jalan Pekeliling Meru Indah.
"After turning back, the accused continued to follow and chase the deceased. When the deceased arrived at the intersection of Jalan Taman Jati 1-Jalan Pekeliling Meru Indah, the accused collided with the rear of the deceased's motorcycle.
"As a result of the collision, the deceased suffered injuries and died at the scene. The medical examination and post-mortem examination revealed that the deceased suffered fatal injuries due to the collision," he said.
Later, presiding High Court judge Bhupindar Singh Gurcharan Singh Preet and all those involved in the trial went down to the court compound to view the Perodua Ativa and Yamaha motorcycle, which are part of the evidence for the case.
Three witnesses were called on the first day of the trial.
The three were Ipoh Police District headquarters complaint counter constable Muhammad Azif Daniel Abdul Ghaffar, its D5 branch exhibits storekeeper Md Zahir Abdullah, and police laboratory forensic investigation officer Nur Fairuz Idris.
The trial continues tomorrow.
The prosecution team also consists of Nasrul Hadi Abdul Ghani, V. Suloshani, and Low Qin Hui, while the defence team is led by M. Athimulan, former Perak police chief Datuk Mior Faridalathrash Wahid, and Aiman Hakim Kamaruzzaman. - November 5, 2024
