Kota Kinabalu: An unemployed man was sentenced to three weeks’ jail and fined RM1,000 or two weeks’ jail by the Magistrate’s Court for assaulting a man in Putatan last week.
Mohd Habir Azizul, 29, pleaded guilty before Magistrate Jessica Ombou Kakayun to causing hurt to one Almasi Jamil Sulong by punching his face at 10pm on Oct 26 in front of the Emax Network shop, Putatan town.
Earlier, the court was informed by the prosecution that prior to the incident, the victim, Almasi, and his son were lifting goods.
When the victim called his son who was heading to another place, an unknown man who was there misunderstood and came towards him in a state of anger, said the prosecution.
The victim explained to the man, later identified as Habir, that he was actually calling his son but Habir did not listen and punched his face repeatedly, the court heard.
Almasi found Habir drunk, said the prosecution.
Almasi’s left forehead was swollen and sore in the mouth and received treatment as an outpatient at the hospital, the court heard.
The charge under Section 323 of the Penal Code carries a jail term of up to one year or fine of up to RM2,000, or both, on conviction.
Unrepresented, Habir applied for a lenient sentence by saying that he regretted his action and confessed that he was not aware at the time of the incident because he was drunk, adding that he had a family to look after.
Inspector Albert Basiri, prosecuting, applied an adequate sentence on the grounds that the offence involved a violent crime.
The court ordered Habir, who has no document, to serve the sentence from the date of his conviction and ordered him to be referred to the Immigration Department thereafter.
Meanwhile, three people were penalised for committing drug-related offences.
Raime Tarala and Sharifa Ahmad pleaded guilty to taking syabu in Penampang and here.
Raime was handed eight months’ jail while Sharifa was fined RM2,000 or eight months’ jail.
They were charged under Section 15(1) of the Dangerous Drug Act which provides for a fine of up to RM5,000 or up to two years’ jail on conviction.
Hadzkin Mubin was jailed nine months after he admitted to having syabu as charged under Section 12 (2) of the Dangerous Drugs Act 1952, which provides for a fine of up to RM100,000 or up to five years’ jail, or both, on conviction.
