
Kota Kinabalu: A 61-year-old security guard charged with raping a minor, will go trial on April 3-4.
Sessions Court Judge Amir Shah Amir Hassan fixed the date for Liwoh Tigoan, whose case was brought up for mention on Friday.
Liwoh is accused of raping the nine-year-old girl on May 3, 2022 at a house in Jalan Kionsom, Inanam, near here.
The offence under Section 376 (2) (e) of the Penal Code carries a jail term of between eight and 30 years, and whipping, on conviction.
The prosecution informed the court that they would call eight witnesses to testify during the hearing.
Deputy Public Prosecutor (DPP) Najihah Farhana Che Awang appeared for the prosecution while Liwoh was represented by counsel Jaikol Situn.
Liwoh was further remanded pending the disposal of his case.
In another case, a 24-year-old man pleaded guilty to causing hurt to a girl while robbing her.
However, the court deferred Sharulnizam Ahmad’s sentencing to April 6.
The prosecution applied for a short date for fact of the case and sentencing as the investigation paper is still with the investigating officer.
Sharulnizam allegedly committed the offence against the 16-year-old girl at 8pm on Jan 15 near the Kedai Lucky Store in Sulaman Central, near here.
He was charged under Section 394 of the Penal Code which provides for a jail term of up to 20 years, and whipping, upon conviction. Pending the date, Sharulnizam was further remanded.
DPP Dacia Jane Romanus prosecuted while Sharulnizam was unrepresented.
