
Kota Kinabalu: A 36-year-old fisherman was charged at the Sessions Court, Monday, with raping his five-year-old cousin.
The man pleaded not guilty before Judge Amir Shah Amir Hassan to committing the offence at 3pm on Jan 30 at a house in Putatan.
The charge under Section 376(1) of the Penal Code carries a jail term of up to 20 years and whipping, on conviction.
The prosecution in applying for a new mention date, objected to bail due to the relationship of the accused and the alleged victim but proposed bail at RM10,000 in two sureties should the court allowed any bail.

Read more The accused, who was not represented, requested a lower bail as he is only a fisherman, had four children and that his wife is currently warded at the hospital.
Amir Shah set Feb 19 for mention and offered no bail.
In another Sessions Court, an unemployed man was jailed five years and ordered given a stroke of the cane for taking drugs for the third time.
Ag Sabri Ag Ali, 45, pleaded guilty before Judge Elsie Primus to consuming Amphetamine and Methamphetamine at 8pm on Sept 22, 2023.
The charge against Sabri also stated that he had two conviction records for similar offence.
He was charged under Section 15(1)(a) of the Dangerous Drugs Act (DDA) 1952 read with Section 39C(1)(b) of the same Act, which provides for a jail term between five years and seven years and whipping of not more than three strokes of the cane.
Sabri was also ordered to be placed under police supervision for three years after that.
Deputy Public Prosecutors Muhammad Al-Hakim Abdul Razak and Tham Pou Jin prosecuted.
