
Kota Kinabalu: The Sessions Court fixed Jan 17, 2023 for next mention of a case involving a 34-year-old man charged with raping his daughter.
Judge Noor Hafizah Mohd Salim set the date for the man whose case was brought up for mention to update the court regarding documents involved in the case.
During the proceedings, the prosecution informed the court that the CIC and chemist reports were ready but several documents were not ready and that the prosecution asked for two or three weeks’ time.
The documents which were ready had been served to the man during the proceedings.
The man is accused of raping the daughter on Aug 11 this year at a house in Penampang.
The offence, under Section 376(3) of the Penal Code, carries a jail term of between five and 30 years, and whipping of at least 10 strokes of the cane, on conviction.
Pending the date, the man was further remanded.
Deputy Public Prosecutor Najihah Farhan Cheh Awang appeared for the prosecution while the man was not represented.
