Kota Kinabalu: A man who raped his daughter after asking her to watch porn was jailed 16 years and ordered to get 10 strokes of the cane.
Sessions Court Judge Amir Shah Amir Hassan handed the sentence to the man who changed his plea and admitted to the charge after four witnesses were called by the prosecution.
The man had raped his 12-year-old daughter between January and May 2022 between 1pm and 11.30pm at a house in Manggatal.
The offence under Section 376(3) of the Penal Code carries a jail term of between eight and 30 years, and whipping at least 10 strokes of the cane, on conviction.
The court ordered the man to serve the jail sentence from the date of his arrest on Dec 12, 2022.
The man has two more charges for committing sexual abuse against his stepdaughter and the trial of the cases would be continued on Feb 20 and 21 next year.
During mitigation, the man who was not represented, asked for leniency saying that he has small children to look after and that he regretted his wrongdoings.
However, Deputy Public Prosecutor Dacia Jane Romanus urged the court to impose a deterrent sentence considering the seriousness and rampancy of the case.
The incident occurred while the victim was sleeping when the man came and hugged her and asked her to watch porn.
Because she was scared of her father, she followed what the father asked her.
The man then asked her to do the act like in the porn video in which the father had raped the victim.
The victim lodged a police report against her father after her stepsister who was allegedly a victim of sexual abuse by the father, had lodged a police report.
The man was arrested following the police reports lodged by the daughter and stepdaughter.
