Raping his daughter: Man’s trial now April 21

Kota Kinabalu: The trial of a 45-year-old man charged with raping his daughter had been re-scheduled to April 21.

Sessions Court Judge Elsie Primus set the date for the man when he requested for adjournment as he wish to engage a counsel.

The man is accused of raping his 11-year-old daughter at 1.57pm on Dec 30, 2021 at a house in Inanam.

The offence under Section 376(3) of the Penal Code carries a jail term of between eight and 30 years, and whipping at least 10 strokes of the cane, on conviction.

The court extended the bail offered to the man and gave a final warning to the accused not to go near the alleged victim or her mother again.

Deputy Public Prosecutor Tham Pou Jin appeared for the prosecution.

Meanwhile, a man was jailed five years and ordered to get a stroke of the cane for taking syabu repeatedly.

Chung Yun Siau pleaded guilty before Sessions Court Judge Azreena Aziz to the charge against him.

He was found taking the drug on Oct 31, 2022 after his urine was tested positive for drug at the Beaufort police station and he has several conviction records for taking drugs.

After serving the jail sentence, Chung was ordered placed under police supervision for two years.

In another case, an illegal immigrant was sentenced to four months’ jail for entering the State without any identification document.

Ibni Musa was arrested on March 3 this year after failing to produce his document to the police at the city area.

The court ordered him to serve the jail sentence from the date of his arrest and referred to the Immigration Department after completing his jail sentence for his biometrics data to be recorded before deportation.
