Raping sister, 3: Man’s e-review set for October 27

Kota Kinabalu: The Sessions Court fixed Oct 27 for e-review of a case involving a 23-year-old charged with two counts of raping his toddler sister and committing carnal intercourse against her.

Judge Elsie Primus set the date for the man to monitor the filing of submissions when the defence closed its case after calling eight witnesses.

The court also fixed on or before Oct 4 this year for the defence to file their submissions and reply by the prosecution on or before Oct 19 this year, and another reply by the defence if any, to be filed on or before Oct 26 this year.

On the first count, he is accused of raping his three-year-old sister at a house in Kota Marudu between 2010 and 2016.

The offence under Section 376(3) of the Penal Code provides for a jail term of between eight years and 30 years, and whipping at least 10 strokes of the cane, on conviction.

On the second count, he allegedly inserted his private part into the sister’s anus at the same place and time.

For the offence, he was charged under Section 377A of the Penal Code which carries for a jail term of up to 20 years, and whipping, on conviction.

The prosecution had called seven witnesses during the hearing at the prosecution stage.

The man was called to enter his defence on April 20 this year after the court ruled that the prosecution had established a prima facie case against the man.

Deputy Public Prosecutor Mas Izzaty Lokman conducted the prosecution while the man who was released on bail, was represented by counsel Datuk Joseph @ Bernard Dalinting.

Meanwhile, three men were jailed five years and ordered to get a stroke of the cane each for repeating to take drug.

They were Jaisyjasur Jamrin, Mohd Sophian Mohd Abbas and Rosli Amat and all of them pleaded guilty separately before Sessions Court Judge Noor Hafizah Mohd Salim.

Jaisyjasur was arrested on July 13 this year after testing positive for drug at the Penampang police station. He has similar prior convictions.

Mohd Sophian was arrested on July 11 after testing positive at the Papar police station and also has similar convictions previously.

Meanwhile, Rosli was arrested on July 15 at the Tuaran police station and has prior convictions as well.

The court ordered the trio to serve the jail sentence from the date of their arrest and to be placed under police supervision for two years after completing their sentence.
