
Kota Kinabalu: A 37-year-old electrician was sentenced to 18 years and ordered to get 10 strokes of the cane for raping his stepdaughter.
Sessions Court Judge Ummu Khaltom Abdul Samad meted out the sentence to the man after ruling that the prosecution had proven its case beyond reasonable doubt against the man on Thursday.
The man was found guilty of raping the 13-years and eight-months-old girl in January 2019 at 8pm at a rented house in Putatan.
He was convicted under Section 376(3) of the Penal Code which carries a jail between eight and 30 years, and whipping at least 10 strokes, on conviction.
The court ordered the man to serve the jail sentence from the date of his conviction which was on Thursday after his application to stay of execution pending appeal, had been rejected.
Nine prosecution and two defence witnesses testified during the hearing.
Deputy Public Prosecutor Siti Hajar Mazlan appeared for the prosecution while the man was represented by counsel P.J Perira.
