
TAWAU: A salesman was fined RM10,000 or three months jail at the Magistrate’s Court, here, Wednesday, after pleading guilty to reckless driving that injured two people in a road accident last year.
The accident occurred when the accused bent his head to pick up his mobile phone which fell on the car mat of the driver’s seat.
Roslee Michael, 49, pleaded guilty before Magistrate Don Stiwin Malanjum for committing the offence at Jalan Utara Baru around 10.30pm on May 7, 2022.
Based on the facts of the case, the accused was driving a Perodua Alza from Sin San Pasir Putih towards Tg Batu Kukusan before getting into the accident with a motorcycle which caused serious injuries to the rider and pillion rider.

Read more Police investigations found that when the accused reached Jalan Utara Baru, in front of the Pemborong Roman building, his mobile phone fell on the mat of the driver’s seat and he lowered his head to pick it up.
The action caused the accused to lose control and went onto the opposite lane and collided with a Yamaha LC135 motorcycle from the opposite direction.
As a result of the accident, the motorcyclist, 27, and his pillion rider, 26, suffered serious injuries, while the accused was not injured.
The victim’s motorcycle was also badly damaged while the Alza was only damaged on the front right side.
The accused, who was not represented, was charged under Section 43 (1) of the Road Transport Act 1987 (Act 333/87) which carries a fine of up to RM10,000 and can be imprisoned for not more than 12 months, if convicted. ASP Joan Lee prosecuted.
