Restaurant owner fined RM2,000 for killing dog with firecracker

A Batu Gajah restaurant owner was fined RM2,000 for killing a stray dog using a firecracker, after claiming he only meant to scare the animal away.

BATU GAJAH: A restaurant owner was fined RM2,000 by the Magistrate’s Court here for killing a stray dog using a firecracker.

Magistrate Azlin Zeti Zainal Abidin imposed the fine, with a default sentence of two months’ jail, on Wong Phan Sang, 64, who pleaded guilty.

Wong was charged with committing mischief by killing the dog at Jalan Seroja, Taman Pusing Baru, Pusing at about 7.30 pm on Jan 28.

The charge, under Section 428 of the Penal Code, carries a maximum penalty of three years’ jail, a fine, or both.

During mitigation, his lawyer Choong Hui Yean said her client only intended to scare the animal after it chased him, causing him to fall off his motorcycle.

Based on the case facts, a stray dog was found dead near a restaurant after residents reported hearing a loud explosion.

CCTV footage obtained by a complainant showed the accused throwing an object at the dog, causing it to die at the scene.

On Jan 31, Wong handed over a transparent container containing a lighter and six multi-coloured firecrackers to the police.

Deputy Public Prosecutor Monisha Pandey prosecuted the case.
