RM1.7m CBT charge: Ex-Seri Mengasih executive let off

Kota Kinabalu: A 65-year-old woman was given a discharge not amounting to an acquittal (DNAA) from a charge of committing Criminal Breach of Trust involving a sum of RM1.7 million.

Sessions Court Judge Elsie Primus gave DNAA to Chua Geok Hwa @ Monica, Thursday, after the prosecution informed the court that the defence’s representation letter was accepted and applied for DNAA to be given to Chua.

Chua was accused of breaching the trust given to her as the Executive Director who was appointed to manage the savings of Seri Mengasih Centre by taking RM1,768,022 through 13 cheques for her personal use.

The offence allegedly took place at the Seri Mengasih Centre, Jalan Selangor, Tanjung Aru, between March and December 2018.

The offence, under Section 409 of the Penal Code, provides for a jail term of between two and 20 years, with whipping and also liable to a fine, on conviction.

Deputy Public Prosecutor (DPP) Mas Izzaty Lokman appeared for the prosecution while counsel Amli Noraufe Nohin defended Chua.

The court ordered the bail paid by Chua to be refunded.

Meanwhile, a 37-year-old man was charged with having 31.1gm of syabu.

However, no plea was taken from Arki Salahuddin after the charge was read to him, pending the chemist’s report on the drug.

Arki is accused of having the drug at 11.30am on Nov 10, this year at Kg Kerongkom in Kota Marudu.

The court set Dec 16 for mention of the case and pending the date, Arki was ordered remanded further.

DPP Tham Pou Jin prosecuted while Arki was not represented.

In another case, two men were jailed five years and ordered to be given a stroke of the cane each for repeatedly taking syabu. Arul Maggran was arrested on June 19, this year after his urine tested positive for drug in Kota Belud police station, while Nor Ikhwan Norekam was detained on Aug 11, 2021 also in Kota Belud police station.

Each of them has two previous conviction records for taking the drug.

After completing their jail sentence, Arul and Nor Ikhwan were ordered to be placed under police station for three years.
