Selling products without licence, labels: Firm fined RM5,800

Kota Kinabalu: A company was fined a total of RM5,800 for selling products containing poison without licence as well as cosmetics without labels.

Limra Multi Trading & Supplies Sdn Bhd through its Director Asaraf Ali Mohamed Nazar pleaded guilty before Sessions Court Judge Ummu Khaltom Abdul Samad, to the three charges against the company, on Monday.

On the first count, the company was fined RM1,800 for having 13 unregistered products at 11.30am on Oct 23, 2019 at the company premises in Jalan Timbuk, Sinsuran Complex, here.

Among the products were Maxi-Peel Exfoliant Solution, BL, Surut Ayu, Blue Wizard , Top Man 3, Freshcare Greentea, Freshcare Splashfruity, Freshcare Citrus, Freshcare Sports, Freshcare Lavender , Freshcare Strong, Vimax and Obat Lintah Warisan Pak Tam.

The offence, under Regulation 7 (1)(a) of the Control of Drugs and Cosmetic Regulations 1984 and punishable under Section 12(2) of the Drug Sales Act 1952, which carries a jail term of up to three years or a fine of up to RM50,000, or both, on conviction.

On the second count, the company was fined RM1,000 for having two types of cosmetics, namely, Collagen Plus Vit E and Special UV Whitening without notifications at the same place and time.

On the third count, the company was ordered to pay another fine of RM3,000 for having for sale seven products containing poison which the company had no licence for, at the same place and time.

Among the poison detected in the products were Tadalafil, Mefenamic Acid and Lidocaine, which are listed in the First Schedule of the Poisons Act 1952.

Meanwhile, in a related case, the director of the company – Asaraf – was fined RM300 or seven days’ jail for having for sale a packet of Candy B Complex containing poison in which he has no licence for.

Sessions Court Judge Noor Hafizah Mohd Salim meted out the sentence to Asaraf for selling the product containing Tadalafil poison at 11.30am on Oct 23, 2019 at the Limra Multi Trading & Supplies Sdn Bhd premises in Jalan Timbuk, Sinsuran Complex, here.
