Kota Kinabalu: A 36-year-old woman was fined a total of RM9,000 for selling products containing poisons without licence, having unregistered products as well as cosmetics without labels.
Sessions Court Judge Ummu Khaltom Abdul Samad meted out the sentence to Jacquline Chang who pleaded guilty to three charges against her.
On the first count, Chang was fined RM2,000 or six weeks’ jail for having for sale 10 products containing poison which she has no licence for, at 11.30am on Sept 10, 2020 at the Rakan Jaya building in Block J, Sulaman Sentral Phase 3, off Jalan Sepanggar Bay, Kuala Manggatal, near here. The charge stated that the poison detected in the products was Tadalafil which is listed in the First Schedule of the Poisons Act 1952.
Chang had committed the offence under Section 13(a) of the Poisons Act and punishable under Section 32(2) of the same Act which carries a fine of up to RM3,000, or a jail term of up to a year, or both, upon conviction.
On the second count, she was fined RM3,500 or spend 10 weeks in prison for having 30 unregistered products at the same place and time.
On the third count, Chang was ordered to pay another fine of RM3,500 or 10 weeks behind bars for having 16 types of cosmetics without notifications at the same place and time.
During mitigation, Chang asked for a lower fine saying that her business was not in good condition and she claimed that she did not know that the products in her possession could not be sold.
However, Prosecuting Officer Amira Diyana Rosman urged the court to impose an appropriate sentence on the grounds that it was a serious offence which involved the public’s health.
Amira informed the court that all the seizure products valued at RM8,017.
