
Kota Kinabalu: A 67-year-old man will know on Jan 6, 2023 whether he has a case to answer on a charge of committing physical sexual harassment against a minor.
Sessions Court Judge Elsie Primus fixed the date for Nasib @ Mohd Yusof Ismail when the prosecution closed its case after calling five witnesses in the hearing.
The court also set on the same day for oral submissions from both parties.
Nasib is accused of committing the offence by touching the seven-year and 11-month-old girl’s private parts between Oct 20 and 21, 2020 at 5am at a house of a village in Kota Belud.
The offence under Section 14(a) of the Sexual Offences Against Children Act 2017 provides for a jail term of up to 20 years, and whipping, on conviction.
The court extended the bail of Nasib pending the disposal of his case.
Deputy Public Prosecutor Tham Pou Jin conducted the prosecution while Nasib was not represented.
