Sexually abusing minor: Man, 62, ordered to enter defence

Kota Kinabalu: A 62-year-old man was ordered to enter his defence on a charge of committing sexual abuse against a 10-year-old.

Sessions Court Judge Ummu khaltom Abdul Samad made the order for Mohd Herman Pawawo, after ruling that the prosecution had established a prima facie case against Mohd Herman.

The court set Dec 19 -20 for Mohd Herman’s defence.

Mohd Herman allegedly committed the offence by caressing the girl’s back at 11.30am on Oct 13, 2019 at a grocery shop in Manggatal, near here.

The offence, under Section 14 (a) of Sexual Offences Against Children Act 2017, carries a jail term of up to 20 years, and whipping on conviction.

The prosecution called eight witnesses at the hearing.

Deputy Public Prosecutor (DPP) Siti Hajar Mazlan who stood in for DPP Fauzi Acho, appeared for the prosecution while counsel P.J Perira defended Mohd Herman.

In another case, a man was sentenced to five years’ jail and ordered to be given a stroke of the cane for repeatedly taking syabu.

Mohd Fazrie Naji admitted before Sessions Court Judge Azreena Aziz, to the charge against him.

He was arrested on June 18 this year after testing positive for drug at the Beaufort police station and he has several priors as well.

After serving the jail sentence, Mohd Fazrie was ordered placed under police supervision for two years.

Meanwhile, an illegal immigrant was jailed four months for entering the State illegally.

Juljerry Abdulhari pleaded guilty to entering the State without any identification document and he was arrested on Oct 21 this year after failing to produce his document to the police.

The court ordered Juljerry to be referred to the Immigration Department for his biometrics data to be recorded before deportation.
