Sexually harassing daughter: Man charged

Kota Kinabalu: A 43-year-old man, charged with three counts of committing physical sexual harassment against his daughter, will go on trial on Aug 10-11 this year.

Sessions Court Judge Azreena Aziz set the date for the man who maintained his innocence to the charges against him.

The court also fixed May 15 this year for pre-trial case management.

On the first count, the man is accused of committing the offence against the 15-year-old girl by putting his private part against the girl’s private part at 7.30pm in March 2021 at a house in Beaufort.

On the second count, he allegedly committed the offence by putting his private part on the private part of the same girl who was at the time 15-years and four-months-old, at the end of July 2021 at 7.30pm at the same place.

On the third count, the man is accused of repeating a similar offence on the same girl who was at the time 16-years and eight-months-old as well as putting his finger into the girl’s private part.

The offence allegedly took place at 8am on Nov 15, 2022 at the same place.

The offence, under Section 14(a) of the Sexual Offences Against Children Act 2017, provides for a jail term of up to 20 years, and whipping, on conviction.

Due to the relationship between the man and the victim, he will face the additional punishment under Section 16(1) of the same Act which carries a jail term of up to five years, and whipping of at least two strokes, on conviction.
