A farmer, aged 58, was given an 18-year prison sentence by the Sessions Court after being found guilty of raping his 14-year-old daughter. The accused, an illegal immigrant, also received 10 strokes of the rotan (a type of cane used for corporal punishment) as punishment, after pleading guilty before Judge Rosli Ahmad.
The crime in question took place on February 11, at approximately 11 pm, in a house located in Pulau Bait, Semporna. The father of nine was charged under Section 376 (3) of the Penal Code. This particular section stipulates a maximum prison term of 30 years and a minimum of 10 lashes for cases of this nature. During the proceedings, Deputy Public Prosecutor Mohd Syahnidzam Ahmad requested a severe sentence, citing both the gravity of the offense and the public interest involved.
He emphasized the long-lasting trauma inflicted upon the young victim and stressed the need for a strong punishment not only to serve as a lesson to the accused but also to deter similar actions in the future. It is worth noting that the accused had previously been sentenced to six months in prison on February 27 under Section 6 (1)(1) of the Immigration Act 1959/63 for an unrelated offense.
However, the court decided that the imprisonment and caning punishments would be served simultaneously, beginning from the date of his arrest on February 12. Furthermore, once the accused has completed his sentence, he will be referred to the Immigration Department for deportation, considering his illegal immigrant status. However, the court ruled that the prison term and whipping would run concurrently, commencing from the day of his arrest on February 12th. Additionally, once the offender completes his sentence, the Immigration Department will take the necessary steps to deport him, given his illegal immigrant status.
