Kota Kinabalu: A 55-year-old shop owner was fined RM3,500 for selling products containing poisons without licence.

Munavar Abd Majeed pleaded guilty before Sessions Court Judge Elsie Primus, Thursday. He was found having for selling five boxes of Choco Fit containing poisons in which he has no licence to sell at 11.40am on July 4, 2019 at the Mazuin Beauty World, Grand Plaza Putatan.

The charge stated the poison detected in the product was Sibutramine which is listed in the First Schedule of the Poisons Act 1952.

The offence under Section 13(a) of the Poisons Act and punishable under Section 32(2) of the same Act carries a fine of up to RM3,000, or a jail term of up to a year, or both, upon conviction.

During mitigation, Munavar who was not represented, asked for leniency saying that he did not know that the product had poisons. However, Prosecuting Officer Andrew Roy Pereira from the Pharmacy Department, urged the court to impose an appropriate sentence on the grounds that Munavar had repeated the same offence.

Andrew said as a repeating offender, Munavar should ensure all products in his premises are safe for consumers and comply with the standard specifications set by the Health Ministry.

He added that the product was found to contain the poisons which was Sibutramine and Munavar has no licence to sell the poison. Munavar paid the fine.
