Slashing brother: Sentencing is deferred

Kota Kinabalu: The sentencing of a 23-year-old man who slashed his brother with a machete was deferred to Aug 29.

Sessions Court Judge Azreena Aziz set the date for Mecralinsius Subin after he requested to see the weapon during proceedings, Friday.

Mecralinsius had pleaded guilty to the charge against him and when the prosecution informed the court that the weapon was not brought to court, Mecralinsius said he wished to see the machete.

The prosecution then applied for Mecralinsius’ sentencing to be deferred.

Mecralinsius is accused of causing grievous hurt to his brother Willi Subin, 34, by using the machete at 1am on July 16 this year at house in Kg Sokid Bundu Tuhan, Ranau.

The offence under Section 326 of the Penal Code and read together with Section 326A of the same Code which provides for a jail term of up to 20 years, and liable to a fine or whipping, on conviction.

Pending the sentencing, Mecralinsius was ordered remanded further following the objection by the prosecution as he and his brother were staying together.

The facts of the case stated that the incident was witnessed by Mecralinsius’ sister who lodged a police report.

On that day, while the sister was inside their house, she heard Mecralinsius and Willi quarrelling.

The sister and her husband saw Mecralinsius holding the machete and slashing Willi.

The husband managed to stop the fight frome getting worst but Willi suffered injuries on his left hand as well as his right ankle.

Willi was send to the Ranau hospital for treatment and the doctor found that his left hand muscles were severed.
