A woman accused of physically abusing her 20-month-old daughter appeared in the Sessions Court in Seremban on Tuesday, where she pleaded not guilty to the charges brought against her. The case, which involves serious allegations of child abuse, has drawn public attention due to the nature of the crime and the age of the victim.

According to details presented in court, the alleged incident took place in the early hours of February 28 at a residence in Taman Sentul, Jalan Besar, Mantin. The mother, aged 35, was accused of strangling and slapping her infant daughter, acts that reportedly caused physical injuries to the child. As the child’s guardian, the woman now faces charges under Section 31(1)(a) of the Children Act 2001. If found guilty, she could face a fine of up to RM50,000, a prison sentence of up to 20 years, or both penalties.

During the proceedings, the prosecution, led by Deputy Public Prosecutor Nurul Balkis Zunaidi, informed the court that the accused may be dealing with mental health issues. Citing concerns regarding her psychological condition, the prosecution requested that she undergo a psychiatric evaluation to determine her fitness to stand trial.

The court accepted the request and ordered that the accused be referred to Permai Hospital in Johor Bahru for a comprehensive mental health assessment under Section 342 of the Criminal Procedure Code. The woman, who was not represented by legal counsel during the hearing, will remain under observation while the psychiatric report is being prepared.

This case underscores the complex interplay between mental health and criminal responsibility, particularly in incidents involving vulnerable individuals such as children. It also highlights the necessity for timely interventions and support mechanisms to safeguard the wellbeing of minors.

In situations involving suspected child abuse, the public is reminded to remain alert to warning signs and report concerns to authorities immediately. Early detection and action can help prevent tragedies and ensure children receive the protection they need. At the same time, society must also consider the mental health needs of caregivers, who may themselves be struggling in silence.

Governments have a duty to reinforce child protection laws, enhance access to mental healthcare, and ensure that systems are in place to support families at risk. Comprehensive child welfare policies must prioritize both prevention and rehabilitation to break the cycle of abuse and neglect.
