Datuk Zaid Ibrahim, former de facto law minister, has advised activist and lawyer Siti Kasim to pursue legal action against Jerlun MP Dr. Abd Ghani Ahmad. This comes after Abd Ghani accused Siti of insulting Islam on several occasions during a parliamentary session, allegations which Siti has challenged him to repeat outside Parliament. According to Zaid, there’s no need for Siti to wait for a public repetition of the accusations, as MPs’ immunity doesn’t cover statements that are not central to parliamentary debate.

In his recent remarks, Zaid underscored that parliamentary immunity only applies when MPs engage in discussions directly related to parliamentary proceedings. He referenced a statement by India’s Chief Justice Dhananjaya Y. Chandrachud, who noted that legislative immunity should only protect “purposeful” matters that serve the democratic process. This means not every comment made in Parliament is immune, particularly if it is deemed irrelevant to the matter being discussed.

Dr. Abd Ghani’s accusations arose during a debate on Budget 2025, where he criticized Siti’s alleged “liberal” views, which he claims challenge Islamic principles. He cited her past criticisms of tahfiz schools and the controversy over socks featuring inscriptions of “Allah” as examples of actions he believes are disrespectful to Islam. He also suggested that “liberal Muslims” create a “dangerous trend” by advocating for religious inclusivity and by promoting interpretations that he argues stray from Islamic fundamentals.

Zaid has expressed support for Siti, acknowledging her vocal advocacy for constitutional freedoms and personal liberties. He suggested that such values are fundamental to a democratic society and should be defended, not attacked, by lawmakers. Zaid also urged Malaysian MPs to stand up for figures like Siti, whose views may represent those of more liberal-minded Malaysians, particularly in the realms of religious interpretation and personal freedoms.

Siti Kasim, known for her outspoken activism, had earlier asked Dr. Abd Ghani to make his statements publicly outside of Parliament, where parliamentary immunity does not apply, so she could pursue legal recourse. Zaid, however, believes that a lawsuit is viable regardless, given the limits on parliamentary protections.

Zaid went further, proposing that the Speaker of the Dewan Rakyat should consider reprimanding Dr. Abd Ghani for what he described as unprofessional behavior. He also challenged Malaysian women’s groups to push back against the long-standing gender-based discrimination in Malaysia, which he says often comes under the guise of religious “protection.”

Public debate continues around issues of religious conservatism and liberalism in Malaysia, with the tensions often highlighted in parliamentary discussions and public statements by high-profile figures. The current situation underscores the growing debate in Malaysia over how to balance respect for Islamic teachings with constitutional freedoms, as well as the role of parliamentarians in navigating this complex relationship.

Many see this case as a litmus test for Malaysia’s evolving approach to issues of free speech, religious interpretation, and gender equality in the public and legal spheres.
