Kota Kinabalu: A 22-year-old man was jailed 12 years and ordered given 10 strokes of the cane for having 68.7gm of syabu.

High Court Judicial Commissioner Amelati Parnell meted out the sentence to Daniel Donny who pleaded guilty to the alternative charge offered to him, Wednesday.

The prosecution had informed the court that the representation letter had been accepted and offered the alternative charge to Daniel.

Daniel had the drugs at 9.10pm on July 11, 2021 by the riverside behind the industrial area at Lorong Kuala Neutron, Inanam, here.

Read more The offence under Section 12(2) of the Dangerous Drugs Act and punishable under Section 39A(2) of the same Act which carries a jail of between five years and life imprisonment, and whipping at least 10 strokes of the cane, on conviction.

The court ordered Daniel to serve the jail sentence from the date of his arrest on July 11, 2021.

Deputy Public Prosecutor (DPP) Azreen Yas Mohamad Ramli appeared for the prosecution while counsel Edward Paul defended Daniel.

In another case, a 35-year-old man was ordered to enter his defence on a charge of trafficking 999.9gm of cannabis.

The court made the order against Mohd Zakhuan Arief Isah after ruling that the prosecution had establish a prima facie case.

The court set July 6 for Mohd Zakhuan’s defence.

He is accused of trafficking the drug at 11.45am on Sept 2, 2020 at the GD Express (GDEX) Miles, Lorong Perindustrian Suria Kolombong, near here.

The prosecution had called 10 witnesses in the hearing.

DPP Tengku Najiha from Customs Department conducted the prosecution while counsel Azhier Farhan Arisin defended Mohd Zakhuan.
