
KENINGAU: A 34-year-old government servant was freed from two charges of having 34.4gm of syabu and an imitation pistol.
Sessions Court Judge Marlina Brahim discharged and acquitted Norshamezi Norisham after ruling that the prosecution had failed to prove its case beyond reasonable doubt against Norshamezi.
On the first count, Norshamezi who is National Anti-Drug Agency (AADK) officer, was accused of having the drug at 9.15pm on Apr 1, 2020 in front of the Crime Prevention and Community Safety Division at Keningau Police Headquarters, here.
The offence under Section 39A(2(r) of the Dangerous Drugs Act carries a jail of between five years and life imprisonment, and whipping at least 10 strokes of the cane, on conviction.
On the second count, he allegedly had the pistol on the same day at the junction to Keningau AADK office.
The offence under Section 36 of the Firearms Act 1960 which is punishable with a jail term of up to one year, or a fine of up to RM5,000 or both.
Seven prosecution and two defence witnesses were called to testify during the hearing.
Deputy Public Prosecutor Eugenie Meredith conducted the prosecution while counsel Luke Ressa Balang defended Norshamezi.
The court ordered the bail to be refunded to Norshamezi.
