Syed Saddiq Back in the Hot Seat as Federal Court Reopens Bid to Reinstate Charges

The Federal Court convened on Thursday December 11, 2025 to examine the prosecution’s move to restore four charges against Muar MP Syed Saddiq Syed Abdul Rahman, months after the Court of Appeal cleared him in a closely watched corruption and abetment case. The hearing marked the latest chapter in a legal battle that has drawn national attention due to the political profile of the former youth and sports minister and the implications tied to campaign funding practices.

A three-judge panel—Datuk Abu Bakar Jais, Datuk Che Mohd Ruzima Ghazali and Datuk Collin Lawrence Sequerah—heard three separate appeals submitted by the Public Prosecutor. The appeals challenge the appellate court’s July ruling that overturned Syed Saddiq’s conviction for abetting criminal breach of trust (CBT), misappropriating RM120,000 in political funds and two associated money-laundering charges.

Prosecutors argued that the Court of Appeal had misjudged both the legal framework and the evidence presented at trial. They maintained that the High Court had correctly found a prima facie case and had sufficient grounds to call Syed Saddiq to enter his defence. The prosecution highlighted testimony suggesting that individuals who withdrew funds had acted under his instruction, asserting that these witnesses had no motive to fabricate their accounts.

The bench, however, scrutinised the prosecution’s reliance on the High Court’s reasoning, pressing for clarification on whether the judge’s brief explanation—stating that a “maximum evaluation” had been conducted—met legal standards. The lead prosecutor conceded that he was unable to produce case law affirming that such minimal justification was adequate.

The prosecution also focused on the RM120,000 said to have been transferred from Armada’s political account into Syed Saddiq’s personal account. While the Court of Appeal ruled that the funds were raised for his own campaign and therefore constituted his property, prosecutors contended that political funds held under a fiduciary arrangement could not be freely appropriated. They warned that accepting the appellate court’s reasoning would weaken laws surrounding dishonest misappropriation under Section 403 of the Penal Code.

According to the prosecution, witnesses had not been informed that the funds were intended to reimburse personal expenses, and any concealment of such decisions from financial controllers pointed to behaviour incompatible with honest conduct.

On the money-laundering charges, the prosecution criticised the Court of Appeal’s approach of tying the fate of the charges to the predicate offence. They argued that the Anti-Money Laundering Act permits conviction for laundering even without a conviction on the underlying offence, and claimed the appellate court misinterpreted the Act by inserting a requirement that does not exist in the statute.

The prosecution asserted that campaign funds were diverted for personal use before being moved into an investment account, contending these actions satisfied the criteria for money-laundering under the law.

Syed Saddiq originally faced charges of abetting a former Armada treasurer in the alleged misappropriation of RM1 million in party funds, misusing RM120,000 in campaign funds and laundering RM100,000 through two separate transfers into his investment account. Convictions for these offences carry potential penalties ranging from hefty fines to maximum jail terms of 15 years.

The Federal Court’s eventual decision is expected to have significant political and legal implications, not only for Syed Saddiq but also for future cases involving political financing and fiduciary responsibilities within party structures.
