
Kota Kinabalu: A 46-year-old primary school teacher was discharged and acquitted by the Sessions Court on Tuesday of a charge of physically sexually assaulting an 11-year-old boy.
Sessions Court Judge Elsie Primus acquitted Rosle Basas (pic) at the end of the defence case after finding that the prosecution had failed to prove the charge beyond a reasonable doubt.
She discharged and acquitted Rosle from the charge.
Rosle had been accused of physically sexually assaulting the boy by kissing his cheek in a classroom at a school in January 2024.
He was charged under Section 14(a) of the Sexual Offences Against Children Act 2017, which carries a jail term of up to 20 years and whipping on conviction.
Rosle was initially acquitted at the end of the prosecution’s case by the Sessions Court on April 29, 2025.
However, the prosecution appealed against the decision and, on April 7, 2026, the High Court allowed the appeal and ordered Rosle to enter his defence.
Deputy Public Prosecutor Nurul Shafeerah Mad Iskim appeared for the prosecution.
Rosle was represented by counsel Zahir Hussien Ahmad Shah.
