Technician fined RM6,000 under Poison Act

Kota Kinabalu: A 40-year-old technician was fined a total of RM6,000 by the Magistrate’s Court here Tuesday on two counts under the Poison Act 1952.

Lim Tieng Fung pleaded guilty before Magistrate Lovely Natasha Charles to committing the offences under Section 9(1) of the Poisons Act 1952 at 1am on Jan 5 this year at the parking lot next to the Mee and Cake House, Penampang Baru, Penampang.

Lim was ordered to pay a fine of RM4,000 or 18 months jail for having 23.63gm of Nicotine and [1-(5-Fluoropentyl)-1H-indol-3-yl](2,2,3,3-tetrametylcycopropyl) methanone (XLR-11) which is listed in the first schedule of the Poisons Act 1952.

On the second count, Lim was fined RM2,000 or nine months jail for having 2.97gm of ‘3,4-MDP-2-P Methyl glycidate’, which is also listed in the first schedule of the same Act.

Meanwhile, two men were penalised for having syabu.

Karedzuan Karlan was fined RM2,600 or 10 months jail after he admitted to having 0.05gm of syabu at 1.30pm on Feb 4 in a house at Putatan PWD quarters, Putatan.

The other man Faizal Halim was sentenced to nine months jail after he pleaded guilty to having 0.07gm of syabu at 11pm on Jan 14 at Inanam town.

They were charged under Section 12 (2) of the Dangerous Drug Act 1952 provides for a fine of up to RM100,000 or up to five years jail or both, on conviction.

In the same court, 12 people were penalised for taking syabu and amphetamine.

They were Rizly De Rizon, Rezzeronicca, Noorlydiana Md Ali, Suhaimi Md Yatim, Bernadus Adrianus, Sabar, Yazid Masbati, Musrail Wara, Henry Majil, Ambrani Nasir, Shabnam Safar and Razman Hawil, who admitted to committing the offence between Jan 9 and March 2, this year at separate locations here and in Penampang.

Rizly was handed 12 months jail, Rezzeronicca, Noorlydiana, Suhaimi, Bernadus and Sabar were fined RM2,200 or six months jail.

Yazid was fined RM1,800 or five months jail while the rest were handed six months jail.

Taking drugs under Section 15(1) of the Dangerous Drug Act provides for a fine of up to RM5,000 or up to two years jail on conviction. Inspector Kelvan Elson Maik prosecuted.
