KOTA KINABALU: A 40-year-old technician who raped and committed physical sexual harassment against his daughter with his second wife, was sent to prison for 13 years and ordered to get 12 strokes of the cane.
Sessions Court Judge Noor Hafizah Mohd Salim meted out the sentence to the man who pleaded guilty, to two charges against him on Friday.
On the first count, he was sentenced to eight years' jail plus 10 strokes of the cane for raping the 14-year and three-month-old girl at night in February this year at a living room of a house in Papar.
The offence under Section 376(3) of the Penal Code provides for a jail term of between eight and 30 years, and whipping at least 10 strokes, on conviction.
On the second count, he was jailed three years for fondling the daughter's breasts for sexual purpose at the same place and time.
The offence was under Section 14 (a) of the Sexual Offences Against Children Act 2017 carries a jail term of up to 20 years, and whipping, upon conviction.
Due to the relationship between the man and the girl, there was additional punishment against the man and the court imposed two years' jail plus two strokes of the cane.
The court ordered the man to serve the jail sentence consecutively from the date of his arrest.
The man was also to undergo rehabilitative counseling while in prison and to be placed under police supervision for three years after releasing from prison.
