A Filipino man who raped a 15-year-old girl and impregnated her has been sentenced to eight years in prison and one stroke of whipping by the Sessions Court.
The court handed down the judgment after Arban Abu, a 19-year-old undocumented immigrant, pleaded guilty to the charge. The incident took place in February 2022 at an unnumbered house in a village in Papar, where Arban was living as a tenant. At that time, he was 18 years old. The victim and the accused were alone in the house when they engaged in a conversation about sex, which eventually led to sexual intercourse. In early March 2022, the victim noticed that she had missed her period and suspected she might be pregnant.
A subsequent pregnancy test confirmed her suspicions. Both the victim and the accused confessed to having had sex in February. They decided to inform the victim's father about the situation, who then filed a police report on March 22, 2022, resulting in the arrest of the accused. The victim underwent a medical examination at Likas Women and Children's Hospital, which confirmed her pregnancy at five weeks and five days. She gave birth to a baby boy on November 4, 2022, and a DNA analysis later confirmed that the accused was the biological father of the child.
It is worth noting that the accused had already faced charges related to illegal immigration prior to these events. On April 4, 2022, he was charged under Section 6(1)(c) of the Immigration Act and received a four-month imprisonment for illegal entry. After completing this sentence, he was to be referred to the Immigration Department.
During the mitigation process, the accused, who was not represented by legal counsel, requested leniency, claiming that the sexual encounter had occurred with the victim's consent. In response, Deputy Public Prosecutor Dacia Jane Romanus argued for a severe sentence, highlighting the victim's young age and the fact that she experienced the trauma of giving birth as a result of the rape.
