On 25 Aug 2023, the Kuala Lumpur Sessions Court dismissed an application by a company director to strike out a corruption charge filed against him for offering a bribe of RM500,000 a year for 15 years to Annuar Musa in connection with the takeover of the KL Tower concession.
The company director had on 31 May 2023, filed an application for the charge against him under section 16 (b)(B) of the Malaysian Anti-Corruption Commission (MACC) Act 2009 to be struck off because it did not state the important details, namely the specific date for the alleged offence.
In March 2023, PM8 was charged with four counts framed under Section 23(1) of the Malaysian Anti-Corruption Commission (MACC) Act 2009 of using his position as the Prime Minister and Bersatu president to ask for a bribe from Bukhary Equity Sdn Bhd and also from Nepturis Sdn Bhd, Mamfor Sdn Bhd and Azman Yusoff.
He was also charged, separately under Section 4(1)(b) of the Anti-Money Laundering and Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001.
On Aug 15, 2023, the High Court discharged and acquitted PM8 on all four charges of abuse of power on two grounds - lack of details in the charges and the accused was charged on offenses unknown to the law.
The High Court Judge further states that the accused should not be left to speculate.
Based on the reports reported publicly, did the Sessions Court take into consideration the judgment handed by the High Court 11 days earlier where it discharged and acquitted PM8 on all 4 charges on the grounds that it lacked details, the same basis which the company director cited in his application for the charges against him to be struck off because it did not contain enough details?
Politicians always use the excuse that the public is easily confused when it is they who are the ones that caused and spread the confusion amongst the public.
In cases like the above, the public is obviously confused with the differing standards applied.
