
Kota Kinabalu: A 41-year-old man with two previous convictions for taking syabu was sentenced to seven years’ jail and ordered to get two strokes of the cane repeating a similar offence for the third time.
Sessions Court Judge Marlina Ibrahim imposed the sentences on Mohd Mirdee Mandan, who pleaded guilty to the charge against him.
After completing his jail sentence, he was ordered to be placed under police supervision for three years.
Mohd Mirdee had took the dangerous drug also known as Amphetamine and Methamphetamine, on June 3 this year after his urine was tested positive for drug at the Narcotics Criminal Investigation Division Office, in Beaufort police station.
The charge stated that he has two previous convictions under Section 15(1)(a) of the Dangerous Drugs Act 1952.
His first conviction was recorded was on June 16, 2023 where he was fined RM1,900, in default six months’ jail and placed two years police supervision.
For his second conviction, Mohd Mirdee was sentenced to seven months behind bars plus two years police supervision on Sept 11, 2025.
Both convictions were handed down at Beaufort Magistrate’s Court.
Mohd Mirdee is now charged under Section 15(1)(a) of the Dangerous Drugs Act 1952 and punishable under Section 39C(1) of the same Act, read together with Section 38B(1) of the Act which carries imprisonment between five and seven years, and at least three strokes of the cane.
Section 38B(1) also provides for the accused to be placed under the supervision of an officer as provided under Section 2 of the Drug Dependants (Treatment and Rehabilitation) Act 1983 after serving sentence, for a period of not less than two years and not more than three years.
Deputy Public Prosecutor Akaash Singh appeared for the prosecution while Mohd Mirdee was unrepresented.
