TNB Tax Dispute Sparks Public Savings Concern—Dr Wee Questions Govt's Intentions

Amidst growing debate over Tenaga Nasional Berhad’s (TNB) RM8.32 billion tax dispute, MCA president Datuk Seri Dr Wee Ka Siong has raised serious concerns about the potential impact on public savings, urging the government to act responsibly in light of the Federal Court’s decision.

Responding to Kampar MP Chong Zhemin’s remarks, Dr Wee emphasized that the matter goes far beyond legal technicalities and revolves around safeguarding the public’s money. He pointed out that over 63% of TNB’s shares are indirectly held by ordinary Malaysians through major public funds such as ASB, EPF, KWAP, and Tabung Haji. With TNB facing a multi-billion ringgit tax bill and associated penalties, he warned that nearly RM5 billion of rakyat-linked funds could end up in government hands—raising the question of whether the administration would prioritize public welfare or budget needs.

Rather than framing the issue through a political lens, Dr Wee highlighted that this is a matter of real financial consequence for ordinary Malaysians. The court ruling, delivered on July 2, had concluded that TNB should have applied for tax benefits under Schedule 7B instead of the reinvestment allowance provision under Schedule 7A—a practice the Inland Revenue Board (LHDN) had reportedly accepted from TNB for decades.

He further noted that the court acknowledged TNB's actions were in good faith, suggesting that this was a shift in interpretation rather than evidence of misconduct. Despite the ruling, the Finance Minister retains the authority under existing tax law to allow TNB to reapply under Schedule 7B and possibly waive the amount in dispute.

According to Dr Wee, placing the full financial burden on TNB would not only harm the company but could also result in a silent erosion of national savings entrusted to these investment funds. The silence or inaction from the government, he suggested, might reflect a troubling willingness to tap into rakyat money under the pretext of legal compliance.

Calling for a direct response from the Finance Ministry, Dr Wee challenged the administration to clarify whether it intends to shield citizens’ savings or redirect those funds to address fiscal shortfalls. The core issue, he stressed, is not political rivalry—but the responsibility of protecting billions in public trust.
