A businessman has been sentenced to 12 years in jail and five lashes after losing his appeal to overturn his conviction for raping his Indonesian maid in 2016.
The Court of Appeal, consisting of Justices Datuk Vazeer Alam Mydin Meera, Datuk Hadhariah Syed Ismail, and Datuk Wong Kian Kheong, upheld the lower courts' decision and found no grounds to interfere with the previous findings.
Justice Wong, delivering the unanimous decision of the court, emphasized that the trial judge had thoroughly examined all the evidence, especially the victim's behavior, including her disclosure of the incident to Sufian's sister-in-law and a friend of the sister-in-law. The court deemed the case to be of utmost seriousness, as employers have a responsibility to protect and guarantee the well-being of their domestic workers.
In this instance, the accused not only failed to fulfill this obligation but also violated it by committing such a heinous act. However, the court did grant Sufian's appeal to reduce his prison sentence from 14 years to 12 years. It is important to note that the court's decision to lessen the sentence does not diminish the severity of the crime committed or the significance of holding perpetrators accountable for their actions.
The ruling serves as a reminder that sexual offenses are treated seriously by the judiciary, particularly when they involve vulnerable individuals such as foreign domestic workers. It reaffirms society's commitment to protecting the rights and well-being of these individuals and sends a strong message that such acts will not be tolerated.
This case highlights the importance of ensuring fair treatment and justice for victims of sexual assault, regardless of their background or occupation. It also emphasizes the need for employers to uphold their responsibilities towards their employees and create a safe and respectful working environment.
