
S. Anand Kumar, a Malaysian tour bus driver, has been charged in connection with an accident that claimed the lives of two Chinese tourists. The incident occurred when the tour bus he was driving overturned, resulting in the deaths of 58-year-old Zhang Ping and 49-year-old Wang Shuhong. Anand Kumar, 32, appeared in the Magistrate’s Court in Raub, Pahang, where he pleaded not guilty to the charges brought against him.
The charges under Section 41(1) of the Road Transport Act 1987 accuse Anand Kumar of causing the deaths of Zhang Ping and Wang Shuhong through reckless or dangerous driving. This section of the Act is stringent, with penalties that reflect the severity of such offenses. If found guilty, Anand faces a minimum prison sentence of five years and a maximum of ten years. Additionally, he could be fined between RM20,000 and RM50,000 for this first offense. The law also stipulates harsher penalties for repeat offenders, who could face imprisonment for ten to fifteen years and fines ranging from RM50,000 to RM100,000.
Apart from the charge of reckless driving, Anand Kumar is also facing a second charge under Section 26(1) of the same Act for driving without a valid license. The penalties for this offense include a minimum jail term of three months, a fine ranging from RM300 to RM2,000, or both. Furthermore, the court holds the authority to disqualify him from driving for life or for a specified period.
The court proceedings were overseen by Magistrate Siti Aishah Ahmad, while the prosecution was led by Muhammad Zamharir Muhammad Zuhid. Notably, Anand Kumar appeared in court without legal representation.
The tragic accident occurred on June 29 at around 11 am. The tour bus, carrying 21 passengers, skidded, hit a road divider at KM16.5 on the route from Genting Highlands to Kuala Lumpur, and ultimately crashed on its side. Among the passengers were the bus driver, an assistant, a tour guide - all Malaysian nationals - and 18 tourists from China. The fatalities, Zhang Ping and Wang Shuhong, were among these tourists.
Police reports revealed a concerning detail about Anand Kumar’s driving history. He is a serial offender with 27 previous summonses, many of which pertain to driving without a valid license. This history of repeated offenses raises significant concerns about the regulatory and enforcement mechanisms in place to ensure road safety.
The broader implications of this incident highlight the need for stringent oversight and enforcement of traffic regulations, especially for commercial drivers responsible for the safety of numerous passengers.
