In a high-profile domestic violence case in Johor Baru, the verdict for a trader accused of assaulting his then-pregnant wife so brutally that she went into a coma has been postponed. Rosmaini Abd Raof, 41, failed to appear in court, citing hospitalization, leading the Sessions Court to reschedule the decision to December 9. The defendant’s absence and the sensitive nature of the case have kept public attention focused on this tragic incident.

Judge Fatimah Zahari granted the delay after Rosmaini’s lawyer, Mohd Salleh Togimin, reported that his client was admitted to Pendang Hospital in Kedah the previous day. According to the lawyer, Rosmaini experienced shortness of breath and collapsed during a football practice. His wife reportedly notified the defense team of his hospitalization.

The allegations against Rosmaini date back to May 4, 2021. He is accused of violently attacking his then-pregnant wife, Jahidah Nordin, at an apartment in Kampung Aman, Larkin. The assault left Jahidah, 46, with severe injuries after she was allegedly struck on the head, face, and hands and even stomped on her back. The injuries she sustained were so severe that she fell into a coma shortly after the attack, remaining in that condition to this day.

The charge was filed under Section 325 of the Penal Code, which can result in up to seven years of imprisonment and a fine. However, with the addition of Section 326A, the court has the authority to impose up to double the maximum sentence, given the gravity of the offense. On January 17 of this year, the court ordered Rosmaini to present his defense, and the case has since awaited a final ruling.

This tragic case has garnered widespread public sympathy for Jahidah, who was a civil servant. After the assault, Jahidah remained in a coma but had to undergo an emergency caesarean section on November 30, 2021, to deliver her baby boy, Eshan Nufail. Now approaching his third birthday, Eshan holds a disabled person’s card (OKU) due to developmental delays. Jahidah’s sister, Fauziah Nordin, shared with reporters that Eshan, at nearly three years old, still cannot walk and weighs only 9.5 kg—his developmental progress assessed to be at the level of a one-year-old.

The family’s ordeal did not end with the assault and Jahidah’s subsequent coma. On March 15, 2023, the Seremban Lower Syariah Court granted a fasakh, or annulment, at the request of Jahidah’s family. This legal dissolution of her marriage to Rosmaini was filed in response to the attack, and it provided a measure of legal relief to her loved ones as they continue to support her and care for Eshan.
